Auto Accident - Philadelphia Police Procedure
Presently, everyone knows to contact the police when involved in a motor vehicle accident. The police can perform an investigation, take statements from witnesses, document property damage, help if anyone is injured and take critical information like the names, addresses, and insurance information of the drivers. As of May 3, 2010, if you are involved in a motor vehicle accident in the City of Philadelphia, the police will not respond to minor automobile accidents in which no one is injured. Therefore, if you are involved in such an accident in Philadelphia, you need to obtain all critical information and file an Accident Report either in person or by telephone.

Automobile Medical CoverageDo you realize that when you are involved in an automobile accident, even if not your fault, your choice of insurance coverage in your automobile policy dictates to what extent you are protected? The choice that you make governs how much medical treatment you will be able to receive, whether you will receive immediate compensation for any lost wages and whether you will be able to seek full compensation for the pain, inconvenience, loss of life’s pleasures, disfigurement and the many intangible losses that may be caused.

Medical Bills
One of President Obama’s primary initial goals is to address what has been called the “Health Care Crisis.” A startling statistic that has been reported is that 62% of American bankruptcies are due to the inability to pay medical bills. When our clients are injured due to the negligence of others, they are not immune from this potential tragedy. However, we strive to protect our clients from contributing to this bankruptcy statistic.

Medical Mistakes
Much of what I do entails the representation of people seriously injured or killed as a result of medical mistakes. Certain medical mistakes are so clearly negligent that Medicare and other insurance carriers refuse to make payments to medical providers for treatment necessitated by these mistakes. In fact, there is a list of 28 “never events” as defined by the National Quality Forum. The full list of these 28 “never events” are attached in the PDF below:

UNDERINSURED MOTORIST COVERAGE
Please, right now as you are reading this email, check your automobile insurance coverage. Look at the declarations page. Make sure you have enough coverage to protect yourself and loved ones.
All of us who drive know that Pennsylvania Law requires that we carry automobile insurance. However, Pennsylvania Law requires that we carry only minimal coverage: $15,000 for liability and $5,000 in medical coverage. But that is not nearly enough to protect yourself or your loved ones. Please allow me to tell you some horror stories that will help emphasize my point. The names of my clients have been changed to protect their anonymity. SOLE PROPRIETORSHIPS & PROTECTING CORPORATE FORM
Many of you are small business owners and many of those small businesses are sole proprietorships. I am sure you realize that it is important to incorporate your sole proprietorship, or business, to protect you and your family from personal liability. Pennsylvania Law shields officers from corporate liability absent a piercing of the corporate veil or application of a participation theory. See First Realvest, Inc. v. Avery Builders, Inc., 600 A.2d 601 at 603 (1991). However, confusion regarding liability is common in sole proprietorships; often times, sole proprietors will sign contracts in their own names. In such situations, another party alleging a breach of contract may attempt to pierce the corporate veil by arguing that the contract or agreement was entered into by the individual who then tries to shift liability to the sole proprietorship. In order to limit the appearance of impropriety, which could cause the piercing of the corporate veil, the sole proprietor must be especially careful to clearly limit their personal liability on the face of a contract or document. Concussion - The Silent Destroyer
Football players and athletes are not the only persons who suffer concussions. As reported on www.CNNHealth.com on January 27, 2009, the best medical definition for a concussion is a “jarring blow to the head that temporarily stuns the senses, occasionally leading to unconsciousness.” Click the link below to read the complete article.

“FACT” Depositions of Treating Physicians
In a disturbing new trend, insurance company lawyers handling compulsory arbitration and Rule 1311.1 cases have adopted a strategy of taking the “fact” deposition of treating physicians and chiropractors. They rely on Pennsylvania Rule of Civil Procedure 4003.6 as the authority which permits them to do so. Rule 4003.6, entitled “Discovery of Treating Physician,” Click link below to read full article.

When a patient commits suicide, Who is to blame?
As stated by Jamison, “The suffering of the suicidal is private and inexpressible, leaving family members, friends, and colleagues to deal with an almost unfathomable kind of loss, as well as guilt. Suicide carries in its aftermath a level of confusion and devastation that is, for the most part, beyond description”
