$425,000 Bicyclist knocked down by Dog causing Brain Injury

On a spring afternoon in Chester County, our client was riding her bicycle more than half way through a planned 40 mile bike ride with friends, when a Boxer dog, who was off a leash and not chained, charged down the driveway into the roadway and crashed into our client’s bike knocking her to the ground.  She was wearing a helmet.  Still, she was caused to lose consciousness for a minute.  The owners of the dog had an electric fence in place and the dog was wearing its collar with its batteries working.  The electric fence was also tested as being in working order.  The dog had simply ignored the shock when it went through the electric fence.

Our client was taken by ambulance to Paoli Hospital.  She was diagnosed with a non-displaced clavicle fracture and a subdural hematoma and subarachnoid hemorrhage in the brain.  No surgery was required.  She endured a four-day hospital stay at Paoli, a 16-day in-patient stay at Magee Rehabilitation Hospital in Philadelphia followed by out-patient through Magee until July 2019.  Her treatment consisted of stabilizing the clavicle fracture with a splint, and anti-seizure medication and PT, OT, and Speech therapy.

Our client is a product designer. She was unable to work for a short period of time but was able to return to work full time without any restrictions.

 Soon after returning to work, she resumed her competitive long-distance bike riding. She experienced no residual symptoms and felt she was 100% recovered as of July 2019, just 4 months after the accident.  Her medical bills were $115,000 and her wage loss was $14,000.

A lawsuit was filed in November 2019 and settled for $425,000 in March 2020.
