Anthony J. Baratta resolved a Workers Compensation claim for 8 ½ years of Future Wage Loss for a 67 Year Old Woman while ensuring that the workers compensation insurance carrier remained responsible for all of her future medical treatment.
Our client was 35 years old when she sustained an injury as a visiting nurse for Holy Redeemer Hospital. Our client has been receiving wage and medical benefits since that time.
Our client hired Anthony J. Baratta, Esq, to represent her after the Defendant filed a Petition in Court seeking to terminate medical treatment for her psychological injury that she alleged was caused by the work injury.
After extensive testimony by medical doctors for both our client and the Employer, by Court ruling, defendant’s Termination Petition was denied and Claimant’s Review Petition to accept the psychological injury was granted.
Four years later, after the Defendant – hired physician determined that our client was capable of returning to work full time in a sedentary position, the Employer filed a Notice to Return to Work.
After extensive negotiations, our client now being 67 years old, agreed to settle her wage loss claim, for payment of $80,000 or 8 ½ years of future wage benefits. Our client’s medical benefits will continue to be paid by the employer under the settlement agreement as well.
